and regulations, and agree that you are responsible
for compliance with any applicable local laws. If
you do not agree to these terms of use, please do
not use the web site. The Travel Goddess reserves
the right, in her sole discretion, to change, modify,
delete or otherwise amend portions of these terms
at any time. Any such alteration, modification, deletion
or amendment shall be effective immediately upon posting
the same on The Travel Goddess website. Please check
these terms every once in a while for changes. Your
continued use of The Travel Goddess website following
the posting of such amendments mean you accept those
changes.
To the maximum extent permitted by any law, The Travel
Goddess specifically excludes any and all liability
for any direct, indirect, special, incidental or consequential
damages arising out of or in any way connected with
the access to and use of, availability of or inability
to access to and use of this website, or the information,
products and services obtained through this website,
the submission of any personal data, including, but
not limited to, bank and credit card details, the
performance or non-performance by The Travel Goddess,
or any unauthorized access or breach of security into
this website through the internet or otherwise arising,
whether based on contract, strict liability, tort
(including negligence), product liability or otherwise
even if The Travel Goddess has been advised of the
possibility of such damages.

The Travel Goddess shall not be liable for damages
of any kind arising out of any failure or delay by
The Travel Goddess in performing any or all of my
obligations contained herein or in respect of any
product or service if the failure or delay is due
to circumstances or cause beyond my reasonable control.
You shall indemnify and keep The Travel Goddess indemnified
against all claims, demands, actions, proceedings
made or brought against The Travel Goddess as a result
of your use of this website and/or any breach of any
term or condition by you.
Additional conditions and terms will apply to your
booking and purchase of travel products and services.
You agree to abide by The Travel Goddess' conditions
of purchase and/or the terms and conditions of any
supplier of the travel products or services.
The prices listed are subject to change without prior
notice and all cruises and tours are subject to availability
at the time of making a reservation. The prices quoted,
unless otherwise stated, do not include international
or domestic air transportation; passport or visa procurement;
travel insurance; airport and port taxes; transfers;
items of a personal nature other than those listed in
the itinerary; excess baggage charges; gratuities and
other items not mentioned being included in each tour
itinerary. Baggage and personal effects are at the owner's
risk throughout the tour/cruise. All 5% discounts
offered by The Travel Goddess are based on double occupancy.
In the event that the tour company does not pay The
Travel Goddess 10% commission, The Travel Goddess will
rebate half of the commission received, for example,
if the commission rate on a tour is only 8%, then you
will receive a 4% discount.
Your Money
When making
a deposit, or final payment, your credit card details
will be passed on to the respective tour/cruise companies.
In some instances, the tour/cruise companies will
accept checks, ask The Travel Goddess for details.
The Travel Goddess does not record your credit card
information. The Travel Goddess does not use your
credit card information in any other way than to pass
it on to the respective tour/cruise companies. The
Travel Goddess does not make any charges to your credit
card.
The Travel Goddess highly recommends the purchase
of travel insurance that protects the purchaser against
the unexpected; in the event of trip cancellation
or interruption for unexpected medical reasons; medical
coverage for illness or injury while abroad; emergency
medical evacuation benefits; protection against baggage
loss, theft or damage. Let's face it, things happen,
it is better to be protected. An ounce of prevention
is worth a pound of cure.
Lastly
The Travel Goddess cannot be held liable for any
incorrect or misleading information contained in this
website. The Travel Goddess acts in the sole capacity
as an agent assisting customers in confirming travel
arrangements with suppliers, carriers, wholesalers
and/or contractors who furnish the transportation
and other related services. The Travel Goddess is
not liable or responsible for any personal injury,
property damage, accident, delay, inconvenience, change
in itinerary or accommodations, or irregular activity
which may occur due to 1) wrongful, negligent or arbitrary
acts or omission on the part of the travel suppliers,
their employees, or others not under direct control
of The Travel Goddess 2) defects or failures on the
conveyance, equipment or instruments under the control
of the travel supplier, or 3) financial insolvency
or bankruptcy of travel suppliers or subcontractors
and 4) but not limited to acts of God, fire, acts
of governments or other authorities, war, civil disturbances,
riots, strikes, thefts, pilferage, epidemics, acts
of terrorism, floods, pestilence, quarantines or dangers
incident to the sea, land or air.
The client, by contacting The Travel Goddess and
making payment directly to the travel supplier, acknowledges
and certifies the position of The Travel Goddess
stipulated
by the foregoing, and agrees to hold The Travel Goddess
faultless and blameless, and further agrees that
restitution
of damages, if any are claimed, shall be sought directly
from the travel suppliers. The Travel Goddess reserves
the right to refuse to do business with anyone.
